These Terms govern access to and use of the Radius Ads Geofencing Shopify application, the website at ads.radiusdelivery.app and related support services (together, the “Service”). By installing or using the Service, you agree to these Terms on behalf of the Shopify merchant or business you represent.

1. Business use and authority

The Service is intended for Shopify merchants and authorized business representatives. You confirm that you have authority to accept these Terms and to access the connected Shopify store, Radius Delivery installation, Meta business portfolio, ad account and Ad Set.

2. The Service

Radius Ads Geofencing reads geography published by Radius Delivery and can apply the geographic portion of targeting to an existing Meta Ad Set selected by the merchant. The current release requires explicit manual approval and restricts production changes to paused Ad Sets.

The Service is a focused geofencing bridge, not a complete advertising manager. It does not create campaigns, Ad Sets, ads or creative; manage budgets, bids or schedules; or edit the source delivery geography in Radius Delivery.

3. Merchant responsibilities

You are responsible for reviewing the selected Radius area, the current Meta targeting, the proposed geography and the final result before relying on it. You remain responsible for advertising compliance, audience eligibility, budgets, bids, creative, campaign settings, consumer disclosures and all final advertising decisions.

Geographic advertising platforms do not guarantee delivery-boundary precision. Radius or proximity targeting may be interpreted by Meta according to its own rules and supported locations.

4. Shopify and Meta authorization

You authorize the Service to use the Shopify and Meta permissions needed for the functions you select. The Meta authorization flow requests ads_management to read authorized advertising assets and update geographic targeting. You must not connect assets you do not own or are not authorized to manage.

5. Controlled changes and rollback

Before a production update, the Service previews the proposed geography, validates it with Meta, preserves the non-geographic targeting object and records a snapshot of the previous geographic state. After an approved update, it reads the Ad Set again to verify the result. A stored geography snapshot may be used for rollback, but restoration remains subject to Meta availability and platform rules.

6. Platform availability

The Service depends on Shopify, Radius Delivery, Meta and infrastructure providers. Their APIs, policies, permissions, review decisions, limits, outages and technical changes may restrict, delay or interrupt functionality. We will use reasonable efforts to maintain compatible operation but cannot control third-party platforms.

7. Acceptable use

You must not bypass safety controls; attempt unauthorized access; connect or modify assets without permission; use the Service for unlawful, discriminatory, deceptive or harmful advertising; interfere with security or operation; circumvent usage limits; or use the Service in violation of Shopify, Meta or applicable law.

8. Data and privacy

You authorize the Service to store encrypted credentials and the minimum store, geofence, ad-account, Ad Set, targeting, snapshot and audit information needed to provide the selected functions. Processing is described in the Radius Ads Geofencing Privacy Policy.

9. Intellectual property

The Service, its design, software, branding, documentation and original content are owned by Multikapitał Sp. z o.o. or its licensors. You receive a limited, non-exclusive, non-transferable and revocable right to use the Service for your authorized Shopify business while the installation and any applicable subscription remain active.

You retain ownership of business configuration you provide and grant us only the rights necessary to host, process and transmit it to provide, secure and support the Service.

10. Availability, maintenance and changes

The Service is provided on an “as available” basis. We may perform maintenance, correct defects, change technical dependencies or modify features for security, compliance, platform compatibility or product development. We do not guarantee uninterrupted or error-free operation.

11. Disclaimers and liability

To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted availability. Multikapitał is not liable for indirect, incidental, special or consequential loss, advertising spend, lost profit, lost revenue, loss of goodwill or platform actions outside its reasonable control.

Our aggregate liability arising from the Service will not exceed the fees paid for Radius Ads Geofencing by the affected merchant during the 12 months before the event giving rise to the claim. These limits do not apply where applicable law does not permit limitation.

12. Suspension and termination

Access may be suspended where reasonably necessary for security, legal, platform-compliance, non-payment or material breach reasons. You may stop using the Service at any time by disconnecting Meta and uninstalling the App. Stored data is then handled as described in the Privacy Policy and Data Deletion Instructions.

13. Governing law

These Terms are governed by Polish law. Courts having jurisdiction in Toruń, Poland will have jurisdiction except where mandatory law requires another forum or grants rights that cannot be waived.

14. Changes to these Terms

We may update these Terms when the Service, law or platform requirements change. The current version and latest-update date will remain available at ads.radiusdelivery.app/terms/.

16. Google Ads pilot

For admitted stores, the App provides Google Ads account and campaign views, geography preview and validation, geographic synchronization, automatic source updates, snapshots and restoration. Writes are restricted to Google Ads test accounts. Applying an area replaces existing geographic inclusions and exclusions and selects presence-based location targeting. Budgets, bidding, ads and campaign status are preserved. Review polygon approximations before applying. Google does not support radius or polygon exclusions, and location targeting cannot guarantee delivery-boundary precision. You must be authorized to manage the selected accounts. Availability depends on Google API access and authorization. Google credentials and connection data are handled as described in our Privacy Policy.
